On March 8, 2013, Plaintiffs filed a Complaint seeking interest on monies, funds, benefits or contributions that CalPERS held or controlled. The proposed class action (BC502628) is filed in Los Angeles Superior Court, and assigned to Judge Shepard Wiley, Jr. in Department 311, in the Central Civil West courthouse.

On March 21, 2013. Judge Wiley set the initial status conference for June 12, 2013.

Death Payments
 



Death Payments CalPERS often fails to pay the death benefit timely and also failed to add, accrue, credit or pay the proper amount of interest as required.
Interest payable on withheld or unpaid death benefits – CalPERS owes interest on withheld or unpaid death benefits from the time that CalPERs received a claim.

Interest payable on withheld or unpaid pro-rata allowance – CalPERS owes interest on withheld or unpaid pro-rata allowances from the time that CalPERS received a claim.

Interest payable on withheld or unpaid survivor continuance – CalPERS owes interest on withheld or unpaid survivor continuances from the earlier of the time that CalPERS received a claim or the time when the payment fell due.

Interest payable on withheld or unpaid beneficiary allowance – CalPERS owes interest on withheld or unpaid allowances payable to beneficaries from the ealier of the time  that CalPERS received a claim or the time when the payment fell due or payable.
