On March 8, 2013, Plaintiffs filed a Complaint seeking interest on monies, funds, benefits or contributions that CalPERS held or controlled. The proposed class action (BC502628) is filed in Los Angeles Superior Court, and assigned to Judge Shepard Wiley, Jr. in Department 311, in the Central Civil West courthouse.

On March 21, 2013. Judge Wiley set the initial status conference for June 12, 2013.

Denied Benefits After Administrative Review, Return of Funds or Contributions by CalPERS With No Interest.
 


Some class members received a refund of the funds, credits, monies, benefits, or contributions they contributed to CalPERS related to a desired benefit, such as for the purchase of prior service credit or optional service credit. CalPERS denied the benefit after administrative review and returned the funds (but without interest) within a year of the filing of this Government Claim Form with the VCGCB. Others will receive such a refund in the future (without interest.) Others received a refund of the monies (again without interest).

In each case, however, CalPERS has failed to add, accrue, credit or pay interest on the funds, credits, monies, benefits, or contributions that CalPERS held.
