On March 8, 2013, Plaintiffs filed a Complaint seeking interest on monies, funds, benefits or contributions that CalPERS held or controlled. The proposed class action (BC502628) is filed in Los Angeles Superior Court, and assigned to Judge Shepard Wiley, Jr. in Department 311, in the Central Civil West courthouse.

On March 21, 2013. Judge Wiley set the initial status conference for June 12, 2013.

The above defined class includes but is not limited to non-Members who have or had money, benefits, contributions, or assets on deposit with, held by, entrusted to, or in the control of the California Public Employees' Retirement System (CalPERS), including those who have or will receive a return of deposits, lump sum or aggregated allowances, credits, payments, or benefits from CalPERS that did not include or receive an increase or accrual for interest.

The above defined class includes but is not limited to individuals who have earned a vested right to benefits, allowances, credits, payments, or benefits from CalPERS that did not accrue or do not accrue an increase or addition for interest.

All members of this class have been or will be substantially and adversely affected by violations of law alleged herein and, hence, have a beneficial interest in the relief sought.

CalPERS is a public retirement association authorized by Article XVI, Section 17, of the California Constitution and subject to the PERL. Authority over CalPERS' operations, formulation of its policy and practice, and approval and ratification of its actions vests in the Board of Administration of California Public Employees' Retirement System. Both CalPERS and its Board of Administration are collectively referred to herein as "CalPERS". CalPERS is a legally separate and distinct entity from the State of California, state agencies, and local public agencies.
