On March 8, 2013, Plaintiffs filed a Complaint seeking interest on monies, funds, benefits or contributions that CalPERS held or controlled. The proposed class action (BC502628) is filed in Los Angeles Superior Court, and assigned to Judge Shepard Wiley, Jr. in Department 311, in the Central Civil West courthouse.

On March 21, 2013. Judge Wiley set the initial status conference for June 12, 2013.

Who Can Be Involved
 


The class for whose benefit this action is being prosecuted is identified as follows:

All individuals who had or have funds, credits, monies, benefits, contributions, or assets that are or were on deposit, withheld by, entrusted to, or in the control of the California Public Employees' Retirement System (CalPERS) where the funds, credits, monies, benefits, contributions, or assets did not or do not receive or accrue interest.


The above defined class includes but is not limited to CalPERS Members who have or had money, benefits, contributions, or assets on deposit with, held by, entrusted to, or in the control of the California Public Employees' Retirement System (CalPERS), including those who have received lump sum or aggregated benefits or payments from CalPERS that did not include or receive an increase or accrual for interest.

The above defined class includes but is not limited to beneficiaries of CalPERS Members who have or had money, benefits, contributions, or assets on deposit with, held by, entrusted to, or in the control of the California Public Employees' Retirement System (CalPERS), including those who have or will receive lump sum or aggregated allowances, credits, payments, or benefits from CalPERS that did not include or receive an increase or accrual for interest.

The above defined class includes but is not limited to non-Members who have or had money, benefits, contributions, or assets on deposit with, held by, entrusted to, or in the control of the California Public Employees' Retirement System (CalPERS), including those who have or will receive a return of deposits, lump sum or aggregated allowances, credits, payments, or benefits from CalPERS that did not include or receive an increase or accrual for interest.

The above defined class includes but is not limited to individuals who have earned a vested right to benefits, allowances, credits, payments, or benefits from CalPERS that did not accrue or do not accrue an increase or addition for interest.
